I met André exactly one year ago. He is a gentle and humble francophone person who is married to an English-speaking wife. They have two children, aged 2 and 4 years. His wife does not work and stays at home taking care of their two toddlers. André used to be the sole breadwinner, working as a public servant, until an unfortunate event occurred. They lost all sources of income for over six months, just after purchasing their first house with a mortgage…
When I saw him back then, during a picnic on one of the first warm Sundays in May in Ottawa, not many of us could envision much hope or a light at the end of the tunnel we found ourselves in. However, he was one of the few who did. He arrived with a large binder containing over a hundred meticulously organized legal documents. He told me in his nice French accent, "I'm not a lawyer, I was never an A+ student, just an average one. But I can do a good job sorting out and organizing the documents, and I will defend myself to seek justice, regain my job, and provide food for the table for my children."
This week, I received a note from him informing me that he will finally have a hearing at the Federal Court, which marks the culmination of his long battle. He is now reaching out and asking for support.

“IT IS ORDERED that the hearing of this matter take place before this Court at the Thomas D’Arcy McGee Building, 90 Sparks Street, in the City of Ottawa, Ontario, on Thursday, the 1st day of June, 2023, at 10:00 in the forenoon for a duration of three (3) hours.” It will be the Attorney General of Canada, represented by two lawyers, versus me. I got to say, I am super ready and looking forward to finally speak in person with the Court.

Summary: “I am arguing that I have been discriminated on the grounds of Genetic Characteristics. The Canadian Human Rights Commission says my case is frivolous and they do not want to send it to the Canadian Human Rights Tribunal for a proper investigation. I have now filed a judicial review at the Federal Court for a judge to determine if in fact I have enough evidence and a prima facie case of discrimination so the correct measures can be taken.”

10. Genetic Non-Discrimination Act (GNDA)11 section 2 says:
➢ “genetic test means a test that analyzes DNA, RNA or chromosomes for purposes such as the prediction of disease or vertical transmission risks, or monitoring, diagnosis or prognosis.”

12. The Genetic Non-Discrimination Act13 (GNDA) was established to provide additional context about Genetic Characteristics. It comes from the Bill S-20114 which was assented into law on May 4, 2017 to prohibit and prevent genetic discrimination.
